Property Management Services
Pursuant to section 3 of the PMSO, the PMSA may, by subsidiary legislation, prescribe a service falling within a category of services set out in Schedule 1 to the PMSO as a property management service. Seven categories of services are set out in Schedule 1 as follows:
Category 1
General management services relating to a property
Category 2
Management of the environment of a property
Category 3
Repair, maintenance and improvement of a property
Category 4
Finance and asset management relating to a property
Category 5
Facility management relating to a property
Category 6
Human resources management relating to personnel involved in the management of a property
Category 7
Legal services relating to the management of a property
Section 7 of the PMSO stipulates that if a property management company’s business does not involve the provision of property management services falling within more than one category of services, the company is not required to hold a property management company licenceNote1.
The prescribed property management services do not include the duties and obligations performed by an owner or owners’ organisation pursuant to the Building Management Ordinance (Cap. 344). Moreover, a property management service incidental to and necessary for the provision of another property management service (primary service) under a category of that primary services will only be regarded as a property management service under the category of that primary service (more relevant information is set out in Frequently Asked Question No. 37).
Note 1: The PMSA will issue guidelines setting out circumstances under which PMSs may be regarded as incidental services.
